All recovery activities undertaken by DCS Capital & Recovery operate within the boundaries of the joint ACCC/ASIC Debt Collection Guideline: For Collectors and Creditors, the Australian Consumer Law, and applicable State and Commonwealth consumer protection statutes.

Status of EngagementDCS Capital & Recovery acts strictly as the appointed agent of the original creditor. The agency does not purchase, acquire, or take assignment of debt. Legal and beneficial title to each account remains with the instructing creditor for the duration of the mandate.

ACCC / ASIC Guideline Adherence

We operate to the standards published in the regulators' joint guideline, including fair contact, disclosure, and dispute handling obligations.

Australian Consumer Law

Conduct is governed by the prohibitions on misleading, deceptive and unconscionable conduct under Schedule 2 of the Competition and Consumer Act 2010.

Privacy Act 1988

Personal information is collected, held, and disclosed in accordance with the Australian Privacy Principles. Encrypted storage and least-privilege access enforced.

Pre-Litigation Discipline

No legal proceedings are commenced without instructing solicitors' review, debtor validation period, and documented service of all statutory notices.

    Notice of Appointment

    Formal authorisation registered to DCS Capital & Recovery. The agency is legally empowered to act on behalf of the creditor, serving the debtor with formal demands and commencing the validation window.

  2. 02
    Overdue Validation

    Where the debtor fails to engage, documentary review is undertaken. A structured settlement offer is extended in accordance with fair-conduct provisions. All contact is logged.

  3. 03
    Final Legal Intent

    Persistent non-engagement triggers referral to instructing solicitors for issue of statutory demand under s459E of the Corporations Act, or initiation of civil proceedings in the appropriate jurisdiction.
